And 573,000 jobs have been created over the last four months—at least there’s a chance that trend could continue.

Arkansas Democratic Senate Primary
In a year of anti-incumbent and anti-establishment sentiment, Sen. Oxford, Miss., will host the first Obama-McCain debate

Somewhere in my attic there is a fading copy of a campus newspaper from 1967—my first year as a law professor at the University of Mississippi. The headline, as I recall, says “Negro to Address Ole Miss Class.” In the space of my own adulthood, a world in which a guest lecture by a black man was a front-page news story has morphed into a world in which a person of color will be speaking on the Rebel campus tonight as a candidate for president of the United States. When my wife and I first arrived in Oxford, Miss., she to teach English and I to teach law, we entered a deeper South than the one we had known growing up in New Orleans and North Carolina. We were not quite prepared for the triumphal playing of “Dixie” and the unfurling of an enormous Confederate battle flag over the entire playing field, marking the opening of every home game. Bullet holes still scarred our faculty apartment building from shots fired when three people died a few years earlier in the turmoil over James Meredith’s admission to the university. Until my wife, Anne, protested Imitation Hamilton Watches, the waiting room of the only obstetrician in town was still divided into designated “white” and “colored” sections.

The law-school dean was a liberal lawyer from Poplarville Replica Baume & Mercier Watches, Miss., who was determined to educate black lawyers on behalf of the state. He recruited some wonderful Mississippi lawyers for the faculty—as well as half a dozen newly minted graduates of Yale Law School. By my second year, more than 50 black students were enrolled in the law school.

I was told some students taped my lectures and sent them to the White Citizens’ Council. In an effort to combine the doctrinal material with the real world of the civil rights struggle, I invited several guest lecturers to my class. Mississippi pharmacist and state NAACP President Aaron Henry was my first guest, followed by the extraordinary civil rights lawyer Marion Wright (now Edelman) and William Simmons of the White Citizens’ Council in Jackson, Miss.

I can’t know for sure whether Aaron Henry was the first person of color to lecture at the university, but the campus paper certainly thought so and made of it a very notable event. One of my students—whose relatives were reputed to be Klansmen—asked whether he could sit in a chair in the hall and listen to Henry lecture through the open door. I told him it would be up to Mr. Henry, who agreed to this “separation” with a ready smile.

It seemed at the time a historic event, which is probably why I still have that old newspaper. The Mississippi state government kept its flags flying proudly at full mast. In response, black students hoisted an American flag back onto the pole and stationed it at half mast. Reports circulated that rural whites with guns were headed to the campus to raise it forcibly to the top of the pole. Black students stood guard through the night. I had composed a guest editorial as a tribute to King for the student newspaper, but because of the concern over the possibility of campus violence, the university was closed and the newspaper did not print that day.

What I had wanted to explain to the campus about King was drawn from an observation by one of my Yale professors, the late Charles L. Black Jr., that the tragedy of Southern race relations is drawn from that prima materia of tragedy: “the failure to recognize kinship.” King had felt the bond of kinship between Southern whites and blacks Where find Replica A Lange & Sohne Watches, and he understood that his work could help liberate the entire South from the grasp of segregation. As I tried to explain to my Mississippi students, King came not to defeat but to redeem his white brothers and sisters.

Sen. Barack Obama comes to Oxford tonight in a far more exalted role than Aaron Henry did in his appearance as a guest lecturer 40 years ago. But while the fact of his race is no longer front-page news, I am nevertheless struck by the thread that connects both appearances. Tonight’s visit to the home of the Ole Miss Rebels by a person of color seeking the presidency of the United States is just one more step on a journey of redemption for Americans, both white and black. The fact that his race is not front-page news tells me we are on the right track.

 

George Zimmerman Needs a Good Lawyer

Florida special prosecutor Angela Corey says she is about to charge George Zimmerman with the shooting of Trayvon Martin. (Update: Corey just charged George Zimmerman with second-degree murder for the shooting of Trayvon Martin. Zimmerman has been taken into custody: He’ll have a bond hearing soon.) What a relief: The place for determining whether or not Zimmerman shot Martin in self-defense, as he claims, is open court. Under Florida’s Stand Your Ground law, Zimmerman is entitled to a hearing before trial so a judge can determine whether his self-defense claim holds up, before he even has to go before a jury.

I hope Zimmerman now finds himself a good lawyer. (Update: Criminal defense attorney Mark O’Mara is now representing Zimmerman; he said Wednesday night that his client would plead not guilty.) In publicly parting ways with him, his old ones have served him badly. Their actions will be overshadowed by Corey’s announcement. But the crazy TV interviews they gave on Tuesday and Wednesday are worth pausing over. The headline from those interviews was that Zimmerman’s lawyers said he’d gone rogue. “I can’t ethically go forward and say that I’m representing George Zimmerman when I haven’t talked to him in a couple of days and he’s giving interviews, apparently,” his former attorney Craig Sonner said Tuesday. As a matter of legal ethics, though Replica Hamilton Watches, it’s Zimmerman’s lawyers who seem to have gone off the reservation.

The rules for confidentiality in the context of a lawyer-client relationship are unequivocal. The American Bar Association’s rules for professional responsibility state that “a lawyer shall not reveal information relating to the representation of a client unless the client gives informed consent.” (There are also a few other circumstances that don’t apply here—for example, a lawyer can talk about the representation if he thinks his client is about to kill or hurt someone, or if the client is suing him.) The Florida bar has adopted a version of the same rule. The duty of confidentiality extends beyond the time of the representation—forever. Lawyers have had anguished battles with themselves over whether to reveal that a client told them that he committed a crime someone else was convicted for Replica Jaeger LeCoultre Watches, even after the client’s death.

And yet, here come Sonner and Hal Uhrig, breaking off that representation on television in a series of statements that reveal all kinds of confidential information that could potentially hurt their former client. The lawyers said Zimmerman, who killed Martin in February and has made an embattled claim of self-defense, was “not doing well emotionally” and “may not be in complete control of what’s going on.” They also said, taking umbrage Where buy best Replica Longines Watches, that he’d called Sean Hannity without going through them. Maybe it’s not a good sign if Hannity is your lifeline, but Zimmerman has the right to talk to anyone he wants. Uhrig and Sonner seemed most concerned that Zimmerman wanted to talk directly to special prosecutor Angela Corey on his own. Yes, that’s odd and probably a bad idea—Corey reportedly said, wisely, that she would only talk to Zimmerman with his counsel. But this is not a fact that Zimmerman’s lawyers should be making public. Since the lawyers also said that Zimmerman hasn’t been calling them back, it’s very hard to see how he could have consented to their amazing release of information.

When I asked NYU law professor and ethics expert Stephen Gillers whether Uhrig and Sonner had broken the rules, he emailed back: “Jaw dropping. Literally. I struggle to find the appropriate adjectives to describe their behavior. The clip will be useful in legal ethics classes under the heading ‘HOW NEVER TO BEHAVE.’ ”

Here’s what Sonner and Uhrig could have said without violating the confidentiality rules: “We are no longer representing Mr. Zimmerman.” Nothing in the Florida or American Bar Association rules permit the statements they made that went far beyond that simple withdrawal. “To the contrary, the Florida and ABA rules forbid” the lawyers’ statements, Gillers said. He added, “Not that it matters Replica Burberry Watches, but perhaps they thought what they said would not hurt or even help Zimmerman. But they cannot know—no one can—how their disclosures may return to harm him. It is possible that what they said will influence the pace or timing of the prosecutor’s investigation to Zimmerman’s disadvantage or affect a judge’s bail decision if there is a charge.” (I tried to reach Sonner for a response, but the number listed on his website isn’t set up to take voicemail. I also emailed Uhrig and I’ll update this piece if he writes back.)

Uhrig and Sonner have company, of course, in bizarre lawyer land. Like Zimmerman’s former lawyers, Amendola grabbed the spotlight, putting his client on television for an interview that could weaken his defense at trial. After a party for reporters at Amendola’s house last December, who according to TMZ were “vying for an exclusive interview” with Sandusky, an NBC correspondent was arrested for drunk driving. And this week a judge issued a gag order in the Sandusky case for lawyers on both sides, after Amendola and the prosecutor took public shots at each other.

And yet even with that laundry list of questionable lawyering, it seems to me that Uhrig and Sonner are in a different category of client harming. Breaking the legal ethics rules isn’t the same as breaking the law—lawyers can’t be prosecuted for this. But they can become the subject of a complaint to their state’s bar and potentially set themselves up to be sued for malpractice. If you’ve already written off the legal profession as a source only of bad jokes, then I suppose you can shrug off the apparent rule breaking of Zimmerman’s lawyers and the questionable judgment calls of Sandusky’s. But lawyers are officers of the court who have pledged to follow the rules of their profession. They also claim important privileges based on their duty of confidentiality—for example, they’re rarely called to testify based on what they learn in the course of representation because, of course, they’ve solemnly promised to keep it confidential.

When a few lawyers break the rules, they blow it for the whole profession. Especially in a high-profile case like this. Whatever you think of George Zimmerman, now that he’s about to face charges, he deserves better lawyers than the ones who just quit on him.

Asylum-seeker numbers drop in Australia

As fresh United Nations figures show the number of asylum seekers coming to Australia has dropped in the past year, the political stoush continues over those who do seek refuge.

A UNHCR report released on Tuesday said the number of asylum seekers coming to Australia last year fell by nine per cent – from 12,640 in 2010 to 11,510 in 2011.

This was largely due to a reduction in the number of people coming to Australia by boat, especially from Afghanistan, it said.

The drop in Australia defied the worldwide trend of a 20 per cent increase in global applications from 2010, with 441,300 seeking asylum in 44 countries covered by the study.

Federal Immigration Minister Chris Bowen told AAP Australia and New Zealand was the only region to record a fall in asylum applications in 2011.

“As this government has always said Aigner Replica Watches, the composition of Australia's asylum-seeker caseload will change depending on factors in asylum seekers' home countries Burberry Replica Watches,” Mr Bowen said.
